Terms of service
1. Who we are
This website is operated by everythingTimber, 16 Europa Avenue, West Bromwich, B70 6TL, United Kingdom. In these terms, "we", "us" and "our" mean everythingTimber, and "you" means the person placing an order.
By using this site or placing an order you agree to these terms. Please read them before you order.
2. Orders and the contract
Adding items to your basket and completing checkout is an offer to buy, not a completed contract. Our order confirmation email is an acknowledgement that we have received it, not an acceptance.
The contract between us is formed when we accept your order, which we do by arranging your delivery day and telling you so. Until then we may decline an order, for example if an item is out of stock, if we cannot deliver to your postcode, or if the price was wrong.
3. Pricing
Prices are shown in pounds sterling and include VAT at the current rate. Any delivery charge is shown at checkout before you pay. For now we offer free local delivery only; nationwide delivery, charged by postcode zone, is coming soon. See our shipping policy.
We try hard to keep prices accurate, but errors happen. If we find that an item was priced incorrectly before we accept your order, we will contact you and give you the choice of paying the correct price or cancelling. We will not simply process the order at the wrong price.
Any volume discounts advertised are applied automatically at checkout on the quantities stated.
4. Product descriptions and natural materials
We describe our products as accurately as we can, but photographs are illustrative and screens vary.
Timber is a natural material and varies in colour, grain, knot pattern and moisture content between boards and between batches. Treated timber lightens and weathers over time. Some movement, splitting and surface checking is normal and is not a defect. Stated sizes are nominal and are measured before planing unless we say otherwise. Concrete products vary in surface finish and shade.
Where a product carries a treatment class, grade stamp or certification, we describe it as supplied to us by the mill or manufacturer.
5. Quantities and suitability
Any quantities, calculations or guidance we provide — including anything produced by a calculator on this site — are estimates to help you plan. They are not a survey and not structural advice. You are responsible for satisfying yourself that what you order is right, in the right quantity, and suitable for your project, ground conditions and any planning or building regulations that apply.
If you are unsure, ask us before you order.
6. Delivery
Delivery terms, zones, prices and access requirements are set out in our shipping policy, which forms part of these terms. Risk in the goods passes to you on delivery. Ownership passes when we have received payment in full.
7. Cancellations, returns and refunds
Your cancellation and return rights, including the statutory 14 day cancellation right and our own 30 day window, are set out in our refund policy, which forms part of these terms.
8. Your rights if something is wrong
If you are a consumer, the Consumer Rights Act 2015 gives you rights that these terms do not affect. Goods must be as described, of satisfactory quality and fit for purpose. Nothing here limits those rights.
9. Our liability
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
Subject to that, we are not liable for losses that were not foreseeable, for loss caused by delay where we have given a delivery estimate in good faith, or for any labour, hire, contractor or consequential costs arising from a delivery being late, short or incorrect. Our total liability in connection with an order will not exceed the amount you paid for that order.
If you are buying in the course of a business, we are not liable to you for loss of profit, loss of contracts, or loss of business opportunity.
10. Trade and business customers
Where you buy for purposes relating to your trade or profession, the consumer cancellation rights in our refund policy do not apply to you. Our 30 day returns window is offered at our discretion.
11. Events outside our control
We are not liable for failure or delay caused by something beyond our reasonable control, including severe weather, vehicle breakdown, road closures, supplier failure or industrial action. If such an event affects your order we will contact you and either agree a new date or refund you in full.
12. Your account and this website
If you create an account you are responsible for keeping your login details secure. You may not use this site unlawfully, attempt to gain unauthorised access to it, or copy its content for commercial use without our permission. All content on this site belongs to us or our suppliers.
13. Privacy
We handle your personal data as described in our privacy policy.
14. Changes to these terms
We may update these terms. The version in force is the one published on this page when you place your order, so please check it each time.
15. Law and jurisdiction
These terms are governed by the law of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
